Rollins said she there is no rhyme or reason why parents are charged, or not, after a death. She said it depends on the prosecutors and law enforcement officers, who will determine whether it was an accident or negligence.

How do you handle these cases?

This is obviously a very fact specific issue.
The answer is, on a cas-by-case basis.

Rollins, in her obscure wisdom, states that there is no rhyme or reason, but clearly this statement is without merit. Every DA's office uses reason and discretion (less rhyme) in charging decisions.

Seems to me a wayward child advocate Pontificating on forgiveness and grief
Abhorring our prosecutorial mandate
Begging the scales relief
(should you wish the rhyme route)
