This is a next time it happens question.

City police stop an individual on a Class C traffic stop. Whatever the offense, the individual is arrested. On the next day city judge sentences to time served for the offense.

The catch is the individual is a suspected illegal and ICE is contacted. City jail is holding, but ICE has not picked up within the, I'm told, 48 hour time limit. What court would have jurisdiction? City, County, District, Federal?

I'm shocked, shocked I tell you!

I've actually been told there is only one agent from the Beaumont office covering all of east Texas temporarily so don't hold your breath.

the 48 hours excludes "Saturdays, Sundays, and holidays" if that is any help. (68 FR 35279)
