Hypothetically, I have a suspect who called her ex-husband's work, pretending to be the wife, and had his work change the email notification address for benefits changed to her (suspects) email address. There was no money to be gained and no action taken as a result of the change.

Harrassment and stalking don't seem to apply and several of the other statutes I've looked at are not a clean fit. So, the question is, "what is the best charge for the facts?"

Maybe Breach of Computer Security? Some of the terms in that offense are defined quite broadly.

What about PC 32.51: Fraudulent Use or Possession of Identifying Information? Seems like that would fit.

For PC 32.51, the difficult issue is finding the "intent to arm or defraud", since getting money wasn't the object.

PC 33.02 Breach of Computer Security sounds like it may be the closest.
