I received my first ketamine possession case this week. I notice that in this past legislative session the house and senate both passed a ketamine statute. The problem is one put in Penalty Group 1 and the other in Penalty Group 2. Has anybody run into this particular problem before?

Look at Gov't Code Sect. 311.025(a). Irreconcilable Statutes and Amendments


This says the later enacted statute prevails. I think in this case the PG1 listing prevails because it was passed after the PG2 listing.
