Warrant Question Login/Join

Officer makes an arrest. The defendant was to be charged with a disorderly conduct and a resisting arrest. However, at the jail the defendant is only booked in for the disorderly conduct. The defendants bond and the magistrate documents are for the disorderly conduct only. Since the defendant was not booked in or bonded out on the resisting arrest, can a warrant be issued for the resisting arrest after the complaint and information are filed?

Yes, but make sure and include a probable cause affidavit to justify the issuance of the warrant in case the defendnat has a trunk full of cocaine when he gets arrested.
