Got it, thanks very much.

Now, what happens if the defendant wins on sudden passion (which would bump the punishment range down to 2 to 20) but I prove up his felony prior (which would have made the minimum 15 on a first degree?). Does it bump the "second degree sudden passion" murder back up to a first degree? Is the minimum then 15 or 5?
