13 y/o is seen smoking a "crack pipe"

Driver of vehicle is 19 at time of offense.

13 y/o med records show THC and Amphetamines in system.

Driver is also charged with SJF possession.

Do I have charge on Delivery to Minor?

Did you ask the minor where he got the goods? Knowing the kids 'nowadays', he probably was the dealer!

Depends on your evidence. Not to be flippant, but it is possible that the 13-year old obtained the dope instead of vice-versa.

Geez, and I just decided to indict on straight delivery.

Okay, drugs were in glovebox. (Driver/19 y/o told officer.)

Car belongs to 19 y/o father.

Crack pipe was dropped out driver side window when occupants noticed DPS trooper approaching.

And you are both right, could possibly have been the juvenile who got the drugs.

I plan to indict the 19 y/o on delivery and possession.
