I received a discovery request today under CCP Art. 39.14 on an MTR. I know that 39.14 doesn't apply to MTR's, but other than the clear wording ("before or during trial of a criminal action") within that section, which is plenty clear to me, I couldn't quickly put my hands on a case that I could cite to defense counsel to explain why I was not going to comply with her request. Does anyone have a case that says that 39.14 does not apply to MTR's?
