Here's an interesting article:

"The Tarrant County district attorney's office recently told judges and defense attorneys it would no longer agree to allow defendants convicted of alcohol-related offenses to work labor detail."

It looks like CCP 42.036(a) forbids community service for "an offense under Sections 49.04-49.08." Any ideas on what could possibly trump that statute?

A defense attorney just told me in the elevator that 43.10 trumps 42.036. I don't see it. Section 43.10 doesn't address serving one's sentence, it just addresses imposing work on a confined prisoner.
