Under the new law, a defendant with a BAC >.15 is now punishable as an "A" Misd. Could the term "an analysis" be extended to include a PBT test alone over .15?

Only if you can get such a test admitted as evidence. Unlikely.

I agree with John, no reason to try this. Were you really going to offer that 1st time offender more than 6 months to do?
