ASGSanctions against defense attorney
Is there authority for the State to ask for sanctions to be assessed against a defense attorney who filed a public document in the case, falsely accusing the state investigator of perjury and Brady violations? Thanks.

Martin PetersonAs one would expect, there do not appear to be any appellate court cases demonstrating the scope or application of art. 1.052. But, a sanction order was issued in Travis County concerning a motion in a criminal case. So, you might try it in your situation. See Reposa (No. 03-17-00479-CR, Austin Court of Appeals, 8/22/17).
