off-duty deputy serving process Login/Join

I have been asked about the propriety about a sheriff's deputy operating a private process service on the side, and haven't had any luck on Lexis or the AG's opinion site. Does anyone know of a bar to this idea, assuming the deputy is not in uniform or otherwise holding himself out as a peace officer when he does this?

So he will be "on duty" when shot while serving process. But "off duty" when he gets paid for private work. It makes the problems posed by a deputy working off duty as security for an adult club look mild in comparison. And he directly competes with the public job.
