Asset forfeiture is timely filed, but possessors at time of forfeiture were not served with notice until 30+ months later. Defense attorney claims I am toast. Am I?

If you can show due dilligence in trying to serve the defendants, you should be ok.

Can you show that the property was a "criminal instrument" or "contraband" subject to forfeiture under art. 18.18? (We are in "Hail Mary" territory., here.)
