We recently had an older woman with Alzheimer's die in our local nursing home. Her family donated her brain for Alzheimer's research, but when the pathologist was removing the brain, he discovered that her death had been not from Alzheimer's, but from a hematoma probably caused by a fall or other blow to the head. Our Justice of the Peace is preparing to decide, after her investigation is complete, whether the death was accidental. If she finds that it is, does she still have to report abuse or neglect of a nursing home patient under Health & Safety Code section 242.122? I can find no cases on this.

It has contact numbers for the AG's Medicaid Fraud Control Unit that investigates nursing home abuse and neglect. Maybe they can help with your question.
