Busted individual selling meth from his home right across street from elementary. Same individual busted 12 years prior for same offense and he went to pen. Myself and law enforcement want to seize the real property.

Looking this morning in the property records the house is owned by a trust with the defendant as the beneficiary. Investigating what type of trust and who is trustee.

First, any forms anyone has on forfeiture of real property including lis pendens would be appreciated.

Second, any help from any of you that has had any experience dealing with forfeiture of real property held by trust for beneficiary of defendant drug dealer.

Third, since property not seized incident to search and arrest need a copy of chapter 59 contraband warrant so we can seize the property legally.

Any help with this would be greatly appreciated.

Lis Pendens in Texas by Steven C. Haley is a useful CLE paper, current through Dec. 2007.
