A two-time convicted sex offender (both victims 11 years old) has moved directly across the street from an elementary school playground in my jurisdiction. He went off parole in Jan. 2002. DPS special crimes has paid him a visit and he does have fingernail polish, etc in his home. He comes out in his yard daily when the kids are playing. The local PD, school, and parents are aware of the situation. Since he is off parole, he is not subject to a "child safety zone." Any great ideas (short of a Rambo parent) on how to get this guy away from these kids?

If your convicted sex offender has two convictions or even deferreds for "sexually violent" offenses [which includes agg sexual assault and indecency by contact plus others], he should be registering or verifying his registration every 90 days. Did he properly register when he moved to the address across from the school? You should check with the appropriate law enforcement agency to see if he is complying, if not, prosecute!

Also, you should find out if DPS has assigned a risk level to this defendant and make sure that public notices have been made pursuant to Article 62.045 if he falls in the proper risk category.

Did this defendant buy his home? Or does he rent?

Thanks for the reply. He is current on his registration and he is not a risk level 3, for notification purposes. I have placed notice in newspaper and visited with the school and neighbors. The guy owns this home.
