As a term of probation, our probationers are required to submit their phones to their PO if requested for review. As expected, inappropriate photos are found from time to time. At that point, the phone can not be returned without putting our PO's in danger of distributing child porn. I would like to create a form to ask the parents to sign turning over the phone (i.e. consenting to both the search and the seizure) with the understanding if after investigation it is determined that the photos are of underage individuals, the phone will not be returned and it will be destroyed, whether or not charges are filed. Right now we are having law enforcement obtain a search warrant, but we'd like to skip this step when we have a cooperative parent. How are others handling this?
