Does anyone have a sample petition the prosecutor can file with a district court to compel a bad guy to submit to a blood draw to test him for HIV/communicable diseases. An officer was stuck with a bad guys needle during a search and is requesting the bad guy be tested. The bad guy is refusing to get tested. We need to compel his co-operation. Time is critical at the moment. Any and all help would be appreciated.

Thanks

Didn't see your post earlier -- do you still need compelled testing forms? Note that if the exposure to the peace officer occurred during the commission of an offense or during an arrest, CCP 18.22 is usually faster and easier.

Let me know if you'd like the H & S 81.050 forms or the CCP 18.22 forms, or both.
