At trial the Defendant was convicted and sentenced with the Jury recommending probation. The visiting Judge who tried the case, ordered a PSI and reset for imposition of sentence. The defendant wants the same Judge from trial to impose sentence and more importantly set the conditions of probation. In my experience the Judge who tried the case generally sets the conditions, but is there any entitlement to have the trial Judge set the conditions of probation?
The trial Judge is available, but does not routinely sit in this county and is not scheduled at this time.
