villescas, the uber enhancement case from the court of criminal appeals that pretty much lets prosecutors off the hook for notice of enhancements, has been withdrawn. sigh.

Martin PetersonObviously Villescas, and Juvrud for that matter, will someday return-- though their clothing may be different. So do not despair. It will be interesting to see what changes are ultimately made in the opinion (or perhaps even the outcome).

Andrea WWell, Villescas has been revived with a new opinion by the CCA. Anyone with a better memory of the original opinion than mine want to speak up with any changes?

Martin PetersonAside from the change "Date delivered: March 1, 2006" to "Date delivered: April 5, 2006", I find no difference. There must be some other explanation for the withdrawal of the original opinion. Or that reason disappeared between March 1 and April 5. Stranger things have happened though.

Maybe Davis and company can tell us what the order filed on March 29 in the case was about.
