Possible offense?

Possible offense?
Situation: online dating service requires applicant to certify that, among other things, the applicant has never been convicted of a felony or any criminal offense characterized as a sexual offense. Lo and behold, an applicant certifies to this fact, but when the dating service checks, there he is--in the sex offender database for aggravated sexual assault. The person is not on parole, deferred, or probation.

Has this person committed a criminal offense under Texas (or federal) law? I couldn't find anything that fit, but I'm not a prosecutor. Help.

If lying on the internet is a crime, we are in for a tsunami of prosecutions. Oh, wait, some legislator, somewhere, just had a light bulb appear over his/her head.
