Does Fifth Amendment apply in writ proceeding?
Working on an actual innocence claim. Wondering if I can call defendant to stand during writ hearing? Most recent case summaries talked about calling defendant to stand in writ hearing, but I'm not aware of authority on point. CCA cases say privilege continues until "liability to punishment" has ended. Obviously, here conviction is final. Does that mean the defendant is fair game? Gotta case?
