I can only presume that the literal requirements of art. 20.16 and 20.17(c)(1), CCP yield to art. I, sec. 5 of the Tex. Constitution and art. 1.17, CCP and Tex.R.Evid. 603 and sec. 110.003, Civ.Prac.& Rem. Code in the same fashion as described in
Scott, 80 S.W.3d at 191-3. Anyone had a subpoenaed witness (in my case the alleged victim of the offense) raise this issue, i.e., refuse to take "an oath" on religious grounds?
