Do we HAVE to indict??? Does a grand jury have to indict as a misdemeanor or can we just file as a misdemeanor by complaint and information?

I have done it both ways. The District Court has original jurisdiction. The last time I did this, it was in another county, the District Clerk did me a favor and took my complaint and information and filed it in the County Clerk's Office---so make sure you talk to the District Clerk first if you are going to do it that way so they understand that it is to be filed at the District Clerk's Office.
