Subsection (c) provides "[i]f conduct constituting an offense under this section also constitutes an offense under another section of this code, the actor may be prosecuted under either section or both sections." Does anyone know whether the Legislature actually meant to punish an educator twice for the same sex act? I'm missing how this passes under the United States Constitution prohibiting Double Jeopardy. The judge is forcing us to elect, and we don't want to up give anything. Thanks.
