I had a call today from a city PD. The PD wanted to know if I knew if any charges had been brought under Penal Code section 38.18, Use of accident report information or other information for pecuniary gain. It went into effect last September. I told her I hadn't heard of any cases being filed. So I am curious. Have any of your offices charged or considered charging someone for an offense under 38.18? The statute seems to be the leg's response to having to remove accident reports, 911 logs, and similar information from the scope of Transportation Ch. 730 due to a district court ruling here in Travis County.
