New Rules for Parole Game
Is it just me, or is anyone else amused at the new "street time" provision for sentence credit created in 2001 in 508.283(c) of the Government Code. See Spann, No. 74,722 (04/21/04) and Mabry, No. 74,864 (06/09/04). Supposedly to benefit offenders who could "successfully" complete more than one-half of their "remaining" sentence upon parole, the Legislature gives them credit toward ultimate release for the time spent on parole. Imagine the poor guy whose revocation warrant is issued just a day before the "mid-point". And what about the truth in sentencing concept of art. 37.07 sec. 4? Should not a jury now be entitled to know about "street time" since that law will definitely affect the true length of incarceration under the sentence? At least these decisions should solve prison overcrowding for a while.
