Officer makes an arrest. The defendant was to be charged with a disorderly conduct and a resisting arrest. However, at the jail the defendant is only booked in for the disorderly conduct. The defendant�s bond and the magistrate documents are for the disorderly conduct only. Since the defendant was not booked in or bonded out on the resisting arrest, can a warrant be issued for the resisting arrest after the complaint and information are filed?

Ken SparksYes, but make sure and include a probable cause affidavit to justify the issuance of the warrant in case the defendnat has a trunk full of cocaine when he gets arrested.
