TexLeoFail To Identify
I am a police officer in a large municipality with very liberal courts. I have a question on Failure to Identify and was hoping for case law to answer my question.
If an officer makes a traffic stop in which there is a driver and passenger, and the passenger refuses to give his name (or gives incorrect name), does this meet the elements of Failure to Identify. This is just a regular traffic stop for speeding in which no one is under arrest, and the passenger has not wittnessed any criminal offense and so forth.
