Judicial Disqualification
The Corpus Christi Court of Appeals has decided a conviction is void when the judge presiding over the case was the county attorney at the time of the original adjudication, even though no one raised the issue and the county attorney did not actively participate in the case. Can you imagine how many cases in Texas will be reversed if this decision stands?

October 24, 2002

IN THE MATTER OF K.E.M., JUVENILE

How does your office handle cases in which the sitting judge previously was a prosecutor?
