Have a case involving a drunk def raping a 14 year old in a car. The def was interrupted once when the child managed to push him off so I charged one count with oral sex and second count with vaginal penetration in one indictment and charged a separate offense for the 2nd penetration in another indictment.The def has filed a mtn to consolidate knowing that the counts can be stacked. I want at least 2 indictments. Occasionally I get a squirrel on the jury who will hang me up but the 2nd time around with another jury its a winner.I've never had a coitus interruptus (SP???) quite like this one. Any thoughts?
