We have a potential material witness to a cold case murder investigation who has completed serving his time in the county jail. He is awaiting ICE to come and get him. We want to keep him here and he is willing to cooperate with us. ICE says they cannot (or will not) delay deportation. Would a writ of attachment under 42.12 apply to keep him here? Should we serve him with a grand jury subpoena and to comply with 42.12? Does anyone have forms?
