Business Records Affidavit + Medical Records Rejected
One of our prosecutors just stepped into my office dumbfounded because our district clerk refused to file his medical records with an attached affidavit for a case coming up at the end of this month.

They provided him with an email from the chief deputy district clerk from 2009 stating that because of SB 763 they were no longer filing any medical records and if someone attempted to file them to reject them.

I looked up SB 763 from the 80R session and it has nothing to do with this and on top of that the Rules of Evidence clearly authorize such a filing.

Has anyone else come across this SB 763 voodoo?

Look at 80R SB763--This only relates to civil actions and shouldn't affect the filing of the records in criminal proceedings.
