County is selling old equipment at public action...a commissioner who has his own construction business is interested in a piece that will be included in the auction. Can he bid on the item as any member of the general public could, and if so, buy the item if he is the high bidder?
I understand the appearance may not be the greatest, but he is wondering if he is precluded.
The court as a whole decided to sell the item at public auction.

I don't think that there is a prohibition...but I would probably prefer not to stand in his shoes if he is up for re-election this cycle.
