Some property owners want the county to vacate right-of-way for an "alley" between lots that were platted in 1893. As far as I can tell, section 251.058 of the Transportation Code controls
if the "alley" is considered a public road. Unfortunately, this 120-year-old plat doesn't even label the "alley" as such; it shows lots and designates streets, but just shows empty space between the lots.
Has anyone had an issue like this before? I've read GA opinions GA-0471 and LO 94-053, but I'd like to see what y'all think.
