Freedom of Information Act
I received an open records request made under the Freedom of Information Act instead of the Texas public information laws. Need some idea of how this differs and what to do. Please call or e-mail if you have some idea of a different procedure.

The FOIA applies only to federal agencies and does not create a right of access to records held by state or local government agencies. That being said, the Texas Public Information Act, which governs requests for information held by Texas state and local governmental entities, generally requires you to respond to any written request for existing recorded information. The TPIA does not require any "magic words" or specific citation to a legal authority. So, even though this request came in (erroneously) under the guise of the FOIA, I would treat it as a request under the TPIA and respond according to the Act's rules.

Man, that Grace guy sure is smart. He's absolutely right. Must be something in the Lubbock water ... which might explain its flavor.
