Reviewing a case and need input on the best charge for the facts. Repair company hires repairman to go to customer's home and repair appliance. Defendant completes the job then gives the customer a price higher than the company guidelines. Defendant directs customer to leave the "Pay To" part of the check blank because he has a company stamp for that. Defendant then writes in his own name, cashes the check, and sometimes gives employer some of the money in cash. The average check is just over $250 and involves a total of 6 to 8 customers, one who is elderly. Forgery (complete writing in an unauthorized manner), theft by deception, other suggestions?

I would charge forgery by completion. He was not authorized to complete the check with his name on it.

Against the elderly individual, you might even be able to elevate that forgery to a third degree.
