Need some help quick on this one. Defendant was arrested on a warrant for Assault FV Class A misdemeanor. A CCP 17.292 emergency protective order was requested by victim. Defendant was magistrated and released yesterday afternoon without an order being issued. Magistrate was going to issue if after a temporary hold under 17.291 but, the jail released him after bail was made and the jail forgot about the temporary hold. Is there some way to get the order in place after the Defendant has made bond and been released from custody?

Once he's magistrated I dont think you can
do an EPO.

You could place conditions on his bond,
or try to get a Family Code P.O. going.

Sounds like the jail staff needs a little chewing on.
