I have been wracking my brain trying to figure out the defense in this. Scenario, Defendant is a repo man and causes a disturbance trying to take the car. Police come out. Gun in plain view in Defendant's truck on the driver's side of the car. When asked who's gun, Defendant says his. Defendant lies about being a felon, then back tracks and says he's not sure but he went jail on a possession charge 25 years ago. Surprise, Defendant is a felon. He is detained, read his miranda rights, and talks. He says it's his son's gun but he brought it even though he knew he shouldn't.....What on earth can the defense be? Defense attorney wants a full day for a bench trial. Any ideas?
check the judgment and the release from probation if he was on CS
Was he released of all disabilities?
