Ok Tex. Transp. Code § 601.261 allows you to impound a car if the guy has 2 No Insurance convictions but ONLY if it was HIS car. The question I have is there any action that can be taken against the owner that is allowing someone to drive in an uninsured vehicle? In our case in addition he's allowing a driver that is not licensed to drive that uninsured car! Arrest has no affect b/c his medical condition.

Stop the driver for DWLI, arrest driver and have the vehicle towed. PR bond for driver, but owner (or driver) will have to pay towing charges. May not work the first time, but if you get 3 or 4, may be sufficient to motivate the owner to stop letting the driver use his vehicle.

Has anyone ever done this? I just want to see what problems you have run into. We would be using a private lot to impound the car after towing. Obviously we need to make an agreement with them.
