Can a Dead Body make a trip to El Salvador? Login/Join

We have an auto accident victim here in Sherman County whom we sent away for an autopsy. Now that the autopsy is complete, the only surviving relative, a sister, wants to take possession of the body, put it in the back of her pick up truck, and drive the body to El Salvador to be buried. Our JP does not want to release the body to any entity other than a funeral home. Health & Safety Code 711.002 and Occupations Code 651.401 provide some guidance, but are not right on point. In the meantime, the dead body has been in cold storage.

Does anyone know if a JP can release an unembalmed body to a relative for transporation across state or national lines?

Look in 25 Texas Administrative Code Chapter 181. In particular, look at Rule 181.3. Chapter 181 rules should provide the information that you need. If you have further questions, I imagine the State Health Department can answer them.
