If the State was not appealing from an order which purported to modify a judgment in Gutierrez, 112 S.W.3d at 204, could someone please explain to me what it was that was the subject of the appeal? Does the case stand for the proposition that whenever a court acts outside its jurisdiction, the state is barred from appealing (even if the act happens to be in the form of a modified judgment)? Fortunately the State has filed a PDR in this case.
