This hasn't happened yet and I'm trying to avoid a show down but, if the following scenario occurs, what do you think? DA instructs Treasurer to begin paying a salary supplement to an employee of the prosecutor�s office and authorizes sufficient funds for salary, miscellaneous with holdings and retirement. Treasurer refuses to handle funds unless the salary increase is approved by Commissioner�s Court. Obviously, the Commissioner�s Court has no authority to "approve or disapprove" the payments. Once the DA authorizes the expenditure from the account, wouldn�t the Treasurer's action in making the payments in accordance with the DA�s instructions be a ministerial act? Same if Commissioner's Court tries to prohibit the Treasurer from handling the payments? | ||
