Has anyone ever filed a motion requesting work product be returned to the State? I have a case where the defense served a subpoena on the police department for their entire file. We didn’t learn of the subpoena until the documents had been given to the defense. Inside the file included investigator/DA's office correspondence regarding the case that are specifically exempt under 39.14.
