What are the options for regaining custody for convicts who are committed to a jail sentence, placed on the work release program, but fail to return to jail as required by the conditions of the work release. Obviously the prosecutor could file escape charges and have a new arrest warrant issued but what are the other legal options? Would an alias capias be appropriate in that situation even though the judge already signed the order committig the convict to jail? Is there some other alternative such as another kind of arrest warrant based on something other than new charges for escape? Most importantly, how do most counties who participate in work release programs handle similar situations? | ||
