The Defendant's slurred speech at the time of his DWI arrest might have been the result of several missing teeth rather than the influence of the alcohol he had consumed. So the next jury will get to do a dental inspection and the prosecutor will no doubt stress some of the other evidence of intoxication (e.g. presence of HGN or bad driving or BTR) in his argument instead. This, of course, makes the questionable assumption Hood County will retry this 1999 offense at this point in time. It is cases like this that emphasize the need for accurate BAC testing.
