I'm going to take a shot in the dark that someone knows the answer to this question. Can a person who is on deferred for theft by a public servant hold elected office in the State of Texas? If anyone has any idea, I would appreciate the insight.

General rule: Texas Election Code 141.001 (a) To be eligible to be a candidate for, or elected or appointed to, a public elective office in this state, a person must: (4) have not been finally convicted of a felony from which the person has not been pardoned or otherwise released from the resulting disabilities; ... ------------------------- See also Vernon's Ann.Texas Const. Art. 3, 20: Sec. 20. No person who at any time may have been a collector of taxes, or who may have been otherwise entrusted with public money, shall be eligible to the Legislature, or to any office of profit or trust under the State government, until he shall have obtained a discharge for the amount of such collections, or for all public moneys with which he may have been entrusted. Also check the statute for the specific office your hero is seeking, since some offices have additional qualifications. [This message was edited by A. Diamond on 10-01-10 at .]
