Ojiaku leaves a bad taste in my mouth. Art. 17.09 sec. 1 CCP requires reappearance "for any and all subsequent proceedings had relative to the charge." Thus, it seems the "obstructing governmental operation" sought to be addressed in sec. 38.10 extends beyond the first failure to appear and that the State could prosecute for at least each court proceeding that was prevented by the absence of the defendant. At least now we have a more definitive answer to an issue that has been unclear for some time. See Previous Discussion Ojiaku.pdf (50 Kb, 12 downloads) | ||
