I have a Driving While Intoxicated case coming up where the intoxicant is Marihuana. Consensual Blood Draw tested at Institute of Forensic Sciences shows 5ng Tetrahydrocannabinol /ml of Blood. Any thoughts on getting before the jury other states presumption or "permissible inference" of intoxication / impairment based on the THC content of the blood?This message has been edited. Not sure how relevant it would be to use another state's law, but you could get an expert to review the studies those states relied upon and the findings they made in drafting their presumptive limits. He could testify to the prevailing scientific belief and his own opinion of intoxication. | |||
