DPS has a standard form requesting restitution for lab fees in all their cases, which is under CCP 42.12, Section 11(a)(19). I'm wondering if anyone else uses a standard form for restitution for businesses? We have a ton of Wal Mart theft cases. Even when merchandise is recovered, they still have to spend a ton of time and effort to re-shelve items, review videos, etc. Plus they employ full-time loss prevention employees. It seems reasonable to assess something like $100 for every case, in addition to any items lost. Any thoughts? | ||

It's been awhile but you might check if they still do this. Wal Mart used to proceed with some type of civil recovery where they assessed $250 or so against shoplifters. Defendant's used to come in w/ proof they had paid that but I haven't seen it in a while. | |||
