DPS has a standard form requesting restitution for lab fees in all their cases, which is under CCP 42.12, Section 11(a)(19). I'm wondering if anyone else uses a standard form for restitution for businesses? We have a ton of Wal Mart theft cases. Even when merchandise is recovered, they still have to spend a ton of time and effort to re-shelve items, review videos, etc. Plus they employ full-time loss prevention employees. It seems reasonable to assess something like $100 for every case, in addition to any items lost. Any thoughts?

It's been awhile but you might check if they still do this. Wal Mart used to proceed with some type of civil recovery where they assessed $250 or so against shoplifters. Defendant's used to come in w/ proof they had paid that but I haven't seen it in a while.
